TERMS
Terms of Service
Last updated: 31 October 2026
These terms apply when you order video production or motion design services from Nova Motion Agency, a trading name of HEADSHOTIST ABUSHAAR (ENK), organisation no. 838 726 712, Urtegata 20A, 0187 Oslo, Norway (“we”, “us”). Contact: hello@digitalservicelab.com.
1. Who our services are for
Nova Motion Agency provides professional video production and creative services exclusively to business clients (B2B), including companies, startups, SaaS and app businesses, e-commerce brands, marketing agencies, and other commercial enterprises.
By submitting a project inquiry or accepting a quotation, you confirm that you are acting in a professional or commercial capacity on behalf of a business, rather than as a private consumer.
If we learn that a customer is a private consumer, we won’t enter into an agreement under these terms.
2. How an order is made
- You send a project inquiry through our website or by email. An inquiry is not an order and costs nothing.
- We reply to confirm the scope, price and delivery timeline in a written quotation.
- When you accept the quotation, we send a secure invoice through Stripe.
- We start production only after the invoice is paid. The agreement between us consists of the accepted quotation and these terms.
3. Packages and prices
- Starter: Social Media Ad: $199 USD. One vertical video of 10–15 seconds, with one revision.
- Professional: Product Commercial: $499 USD. A 15–30 second video, with two revisions.
- Premium: SaaS & App Launch: $999 USD. A 20–45 second video, with three revisions.
- Enterprise: Custom Production: from $2,499 USD. Scope tailored to your brief; revisions and final price as stated in the quotation.
- Prices are in USD. The final price is the one in the accepted quotation.
- Founding Client Offer: founding rates apply to our first five confirmed client projects, subject to availability.
- Taxes: we are currently not registered in the Norwegian VAT Register (MVA), so no Norwegian VAT is charged. Any taxes that apply to you are disclosed on the quotation or invoice. If our VAT status changes, we will state it on quotations.
4. Payment
- Payment is made by secure Stripe invoice. We never take payment on the website.
- Starter, Professional and Premium: the full price is paid in advance. We start production only after the invoice is paid.
- Enterprise (custom productions): 50% of the quoted price is invoiced when you accept the quotation, and we start production only after it’s paid. The remaining 50% is invoiced when the final video is ready, and we deliver the final files once it’s paid.
- Invoices are due 7 days from the invoice date. The delivery timeline in the quotation starts when we have received both the payment and the materials needed to begin (see section 5).
5. Your materials and cooperation
- You provide the information and materials reasonably needed to produce your video, such as logos, product or service details, website or social media links (if available), screenshots, screen recordings, footage, and feedback, within the agreed timelines.
A website is not required to order our services. - You confirm that you have the right to let us use any material you supply, and that it doesn’t infringe anyone else’s rights.
- Delays in material or feedback from you may move the delivery date.
6. Delivery and revisions
- We deliver the video in the format and timeline agreed in the quotation.
- The number of included revisions follows your package (section 3) or quotation.
- A revision means changes within the agreed scope, such as text, timing, colours or swapping supplied assets. New ideas, a new concept, a different length or extra versions are scope changes and may cost extra.
- You can request your included revisions within 14 days of each delivery. If we receive no revision request within 14 days, the project is considered approved. Later changes are quoted as additional work.
7. Rights to the finished video
- Copyright stays with Nova Motion Agency. After full payment, you receive a perpetual, worldwide, non-exclusive licence to use the final delivered video for your own marketing and business purposes, including your website, social media, presentations and paid advertising.
- You may trim, crop or reformat the delivered video for these purposes. You may not resell it or license it to others as a stand-alone product.
- We won’t license your finished, branded video to unrelated third parties.
- Deliverables are the final video files in the agreed formats. Source and project files (such as Remotion code, editing projects and layered artwork) aren’t included. They can be provided on request for an additional fee, agreed in writing, and may exclude our reusable tools and templates.
- If a project is cancelled before completion, the licence covers only finished work that has been fully paid for. Unfinished work, source files and editable project files are not included unless we agree otherwise in writing.
- You give us permission to use the materials you supply to produce your video, and, where portfolio use applies, as part of the finished video we show.
- Third-party elements, such as licensed music, fonts or stock images, are used under their own licence terms. We tell you about any restrictions.
- Portfolio: we may show the finished video in our portfolio and on our social media, unless you ask us not to in writing before production starts. If you ask, we’ll wait until you’ve published the video yourself.
8. Cancellation and refunds
When production starts: production starts when we begin the agreed creative work, including research, scripting, concepts, storyboarding, animation or editing.
If you cancel:
- Tell us in writing (email is fine).
- Before the invoice is paid: there’s no cost. The quotation simply lapses.
- After payment, before production starts: you receive a full refund.
- After production has started:
- we may keep a reasonable payment for the work completed up to the cancellation, in proportion to the agreed price;
- we may also keep any agreed non-refundable third-party costs we’ve already paid for your project, such as licensed music or stock material;
- any remaining prepaid balance is refunded.
- On request, we give you a short written breakdown of the work completed and costs kept.
Inactive projects: if we don’t receive materials or feedback we need for 60 days after requesting them, we’ll send reasonable reminders and then a final written warning giving you 14 calendar days to respond. If there’s still no response, we may close the project. A closure is treated as a cancellation by you, and any refund or retained payment follows the principles above and applicable Norwegian law.
If Nova Motion Agency cancels: you receive a refund for the part of the project not completed.
Enterprise projects (50% / 50%): the same principles apply.
- The deposit is set against the work completed and the agreed non-refundable third-party costs, and any unused part of the deposit is refunded.
- The second payment is only invoiced for work actually completed.
- You never pay more than the agreed price.
Refunds are paid within 14 days of the cancellation, to the original payment method where possible.
These terms apply subject to applicable Norwegian law.
9. Liability
- Our total liability under an agreement is limited to the amount you paid for that project.
- We are not liable for indirect losses, such as lost profit or the results of advertising campaigns.
- We don’t guarantee specific sales, views or campaign results.
- We’re not responsible for delays caused by events beyond our reasonable control, such as serious illness, technical outages or disruptions at our service providers. If this happens, we’ll tell you promptly, make reasonable efforts to reduce the delay and agree a revised timeline where appropriate.
- Nothing in these terms limits liability that cannot be limited under Norwegian law, such as liability for gross negligence or intent.
10. Privacy
We handle personal information as described in our Privacy Policy.
11. Changes to these terms
We may update these terms. The version that applies to your project is the one in force when you accept the quotation.
12. Governing law
These terms are governed by Norwegian law. We’ll first try to solve any disagreement amicably. If that isn’t possible, disputes go to Oslo tingrett (Oslo District Court) as the agreed court.
